Law needed to protect personal medical information

How would you feel about your personal health information flowing freely over the Internet between public health officials, health- care providers, insurance and data clearinghouse companies, and others — without your permission?

If this doesn’t sound like a good idea, it’s time to become informed about federal health-privacy law.

Today, when Americans visit a health-care provider for services (including dental and eye exams), they receive a form with a title such as “Notification of Privacy Rights.” Many assume that signing the form guarantees that personal information won’t be shared with third parties. But the form offers no such guarantees. And neither does federal law.

In fact, the privacy rule established under the Health Insurance Portability and Accountability Act of 1996 legally permits health- care providers to share patients’ information with more than 600,000 health- and data-related entities — without a patient’s consent. Yet the notification form doesn’t clearly explain this.

Individuals control their information when they give consent; they don’t with notification. When you sign a notification form, all you are doing is acknowledging its receipt. The HIPAA notification form offers no control over who sees your information and instead just tells you about some of the entities that can access your information, rather than asking for your permission.

Consequently, many physicians and other health-care providers are urging Congress to strengthen privacy rights. They know firsthand that the HIPAA rule fails to ensure true confidentiality.

“The regulations under HIPAA, which were intended to extend patient privacy as we moved from a paper-based system of medical records to a digital system, are a sham. HIPAA allows the routine release of personal health information without patient consent or knowledge and even over a patient’s objection,” stresses Dr. Janis G. Chester, president of the American Association of Practicing Psychiatrists.

As the ACLU put it, “HIPAA has so many medical privacy loopholes, it makes Swiss cheese look solid.” The organization also points out that under existing federal regulations, the term “privacy” hasn’t been well-defined. The ACLU is urging Congress to define medical privacy as “patient control of electronic medical records.”

Moreover, these organizations and others are lobbying for privacy amendments to key health Internet-technology bills currently being considered in Congress.

New.s-Medical.net reported in early September that a recent CDC report about new annual HIV infections in the United States excluded data from Puerto Rico, with the fifth-largest concentration of HIV cases nationwide. This omission could have widespread consequences say Hispanic HIV/AIDS advocates.

National HIV/AIDS estimates that do not accurately reflect HIV incidence among Hispanics could result in fewer resources allocated for prevention and treatment for that population. The CDC did not include Puerto Rican HIV infections because it uses census population data for the report, whereas Puerto Rico estimates population differently.

Wal-Mart Stores Inc. is advancing plans to launch its own credit card in China in a partnership with GE Money and Shenzhen Development Bank, according to a June 25 article in the Financial Times of London.

The card will be the first of its kind to be issued by a foreign retailer in China. Wal-Mart currently operates 57 stores in China with plans to open 18 to 20 more in that country this year.

The credit card would be issued by SDB, a mid-sized lender in south China, with support from GE’s consumer finance unit, which announced plans for a $100 million investment in the bank last October, FT reported.

THE ALAMEDA Animal Shelter has announced that the 2008 Animal Adoption Reunion will be held 1 to 3 p.m. March 7 at the shelter, 1590 Fortmann Way.

In 2008, the City of Alameda Animal Shelter was able to find new homes and families for more than 350 cats, dogs and rabbits, as well as a number of birds, rodents and reptiles. Those families interested in participating in this reunion celebration are urged to attend and provide a picture of the pets adopted in 2008, for the shelter’s updated Wall of Fame, as part of their beautification program. Pictures can be mailed to the shelter or may be taken at the reunion.

The shelter will be giving away kitty and doggy treats, pet toys and other door prizes. Pets and families are welcome. It is requested that your pets be leashed or kept in carriers for this occasion.

Due to the limited parking at the shelter, they request you park on Fortmann Way or Grand Street and walk to the shelter. For more information, call 510-337-8573.

PET OF THE WEEK: PETUNIA is a black female bunny that was found on the East end. She appears to have been attacked as a small part of one of her ears in torn off, but is a friendly little girl who could use a humane rescue.

Pet bunnies should be kept inside your home and/or in cages large enough for freedom of movement. Bunnies put outside are likely to become prey to predator animals and will likely wander off. One needs a cage with a bottom, to prevent foot injuries. They are adaptable to litter box training (Petunia appears to have previously completed Litterbox 101). She needs to be spayed or neutered for the sake of her health. Rabbits eat pellets, fresh vegetables (see the Internet for lists of safe food) and need fresh water daily. They can be let out of the cage for a bit of exercise and curiosity satisfaction and can be gently held once they are used to the humans in the home. It is best that families adopting bunnies do not have very small children as the bunny can be easily injured.

DOG ALLEY: REYNA, a brindle pit bull mix, is a chocolate female, on the submissive side and may be a little shy when you first meet, but once you show an inclination to rub her tummy or scratch her ears, she warms right up and will snuggle up to you. She is a young adult and is sweet through and through.

A sweet, brindle girl, LUNA can be a little shy to know you at first, but after going on a walk, she’ll have a chance to size you up as a good person. Luna is an active terrier mix.

IVY is a poised and sweet little girl of a Dalmatian/ Labrador mix with a white coat and a few light tan markings. It is believed that she is deaf, but is only a young adult. She will win you over at once with her gentle ways and friendly disposition.

BLACKIE is a male adult chow/terrier mix of deep black with a short but rugged stature and has the looks of a Sun Bear. His human companion has become ill and Blackie is now longing for another home.

CAT LAIR: Good news — longtime resident, MORGAN, the large gray tabby, has been adopted. We are so happy for her, as she was at the shelter for a year, and never lost her good manners.

CLEMENTINE is a stray cat who came to the shelter in mid- November. She is a female adult who was unsure of herself at the first, but has become more relaxed. Clementine doesn’t solicit pets, but she enjoys being scratched between her shoulder blades, and a gentle face rub may elicit a soft purr. Clementine has long white fur and has great markings of black ears and a white coat.

BLANCA is a beautiful, gentle spayed female adult with a long white coat and stunning blue eyes and a soft pink nose. She can be hesitant in new situations, but is eager for a gentle stroke and a dangly toy.

MIMI is the most mellow cat around

Stars launch charity appeal

A TYNESIDE charity is launching a fundraising effort in memory of a footballer and coach who died earlier this year.

The Tim Carter Appeal, in association with Sunderland FC, aims to raise money to enable the Percy Hedley Foundation, in Newcastle, to build a hydrotherapy pool for children with cerebral palsy and other communication and sensory impairments.

The pool would complement the facilities available at the Percy Hedley Sports Academy.

The foundation provides services for disabled children and adults in the region and was a cause close to Tim’s heart.

His youngest son attends Percy Hedley School, which is part of the charity.

Sunderland chairman Niall Quinn, who kicked off the appeal launch at the Stadium of Light, said: “Tim was a fantastic servant to the football club and, more importantly, was a wonderful, gentle man who is missed by us all.”
